Section 1: Preamble and Identification of Parties
This document constitutes the legal framework governing financial contributions ("Gifts") made to the owner and operator of the digital platform slotlist.it (hereinafter referred to as "the Owner"). By initiating a transaction via the designated PayPal portal, the individual or entity making the transfer (hereinafter "the Donor") confirms full acceptance of these terms.
The Owner operates slotlist.it as a private, non-commercial endeavor for the benefit of the gaming community. This platform is not an entity, corporation, or non-profit organization (NPO).
Section 2: Legal Nature of the Contribution
Every contribution is hereby classified as a purely gratuitous personal gift (liberalità d'uso) for the sole benefit of the Owner as a private individual. The Donor explicitly acknowledges that:
- The Gift is a recognition of the Owner's intellectual labor, creative effort, and personal time spent maintaining the platform.
- The Gift is not a payment for services, nor is it a contribution to a collective fund or a charitable trust.
- The Gift is made in the absence of any "cause" or "consideration" other than the Donor's spontaneous desire to benefit the Owner personally.
Section 3: Absolute Discretion and Ownership of Funds
Upon the successful completion of the PayPal transaction, the funds become the exclusive, unconditional, and private property of the Owner. The Donor grants the Owner absolute and unfettered discretion regarding the allocation of these funds. Specifically:
- The Owner may, but is under no legal or contractual obligation to, use the funds for server maintenance, hosting, or technical improvements of slotlist.it.
- The Owner is expressly authorized to use the funds for personal expenses, private investments, leisure, or any other individual purpose without restriction or duty of accountability.
- The Donor waives any right to audit, monitor, or demand documentation regarding the specific use of the gifted funds.
Section 4: Compliance with Italian and International Law
This Policy is drafted to ensure maximum protection under the Italian Civil Code and relevant international common law principles:
- Art. 783 c.c. (Donazione di modico valore): The contributions are defined as small-value donations which are perfected by the mere delivery of the asset (the transfer of funds), requiring no formal public deed.
- Art. 770 c.c. (Liberalità d'uso): The contributions are recognized as customary gifts given out of gratitude or personal appreciation, which do not constitute a formal contract.
- Art. 1322 c.c. (Autonomia contrattuale): The parties exercise their autonomy to define the nature of this transaction as a non-commercial, personal transfer of wealth.
Section 5: Irrevocability and Waiver of Claims
All Gifts are final and irrevocable. By completing the transfer, the Donor irrevocably waives the right to seek a refund, reversal, or chargeback. The Donor further agrees to indemnify and hold the Owner harmless from any legal claim arising from the Donor's dissatisfaction with the platform's features, availability, or the Owner's personal use of the funds.
Section 6: Non-Retroactivity Clause
This Policy applies exclusively to transactions initiated on or after May 13, 2026. Any donations received prior to this date shall be handled according to the representations made at the time of those specific transactions. No clause in this document shall be construed as having retroactive effect.
